What happened
The Delhi High Court directed India's Copyright Office to decide within eight weeks on American AI researcher Stephen Thaler's application for copyright protection. Thaler seeks recognition for "A Recent Entrance to Paradise," an artwork he claims his AI system, DABUS, generated independently. The Copyright Office previously objected, asserting only natural persons qualify as authors. This action follows Thaler's similar, rejected claims in the United States, United Kingdom, and European Union.
Why it matters
Intellectual property ownership for AI-generated assets in India will be clarified. The Delhi High Court's ruling will define how Indian law interprets authorship for AI-created works. This decision directly addresses whether AI content fits India's copyright system, traditionally assigning authorship to human creators, contrasting with rejections in US, UK, and EU courts. The outcome will establish a precedent for future AI-related IP disputes.
