What happened
Neurotechnology, including devices from companies like Neuralink, now collects sensitive brain data, encompassing thoughts, emotions, and beliefs. While Colorado and California have enacted some neural data privacy laws, these are considered insufficient. US Senators proposed the Management of Individuals' Neural Data Act (MIND Act) to study and recommend national standards and ethical guidelines for consumer wearables tracking neural data.
Why it matters
The current lack of comprehensive national regulation for neural data and its inferences introduces a significant oversight burden. This increases exposure to potential misuse, including profiling and manipulation, due to the absence of explicit policy gates or stated liability. Compliance, IT security, and procurement teams face heightened due diligence requirements for managing and securing sensitive neural data from consumer wearables.
